MLG ATTRONEYS SUCCESSFULLY DEFEND CLAIM PETITION THROUGH PERSONAL ANIMUS DEFENSE

A claimant sustained substantial orthopedic and neurologic injuries at work as a result of her being attacked by a co-worker. She obtained an attorney who filed a Claim Petition on her behalf seeking payment of past-due and ongoing wage loss and medical benefits. MLG Attorneys were able to establish before the WCJ that the altercation stemmed from personal animus between the two employees and was not in any way related to their employment despite the claimant’s assertion to the contrary. Based on that defense, the WCJ denied the Claim Petition in full on the grounds that the claimant’s injuries were sustained outside the course and scope of her employment. MLG’s successful defense of the Claim Petition saved the employer/carrier from having to pay tens of thousands in past-due wage loss and medical benefits in addition to thousands in litigation costs incurred by the claimant’s attorney not to mention the exposure of open and ongoing benefits into the indefinite future had the Claim Petition been granted.
