WCJ'S AWARD OF EXORBITANT PENALTIES AND FEES REVERSED UPON APPEAL

Several years after the approval of a compromise and release agreement, a WCJ in the Bristol, Pennsylvania hearing office awarded $78,000.00 in penalties and attorney fees on a Penalty Petition filed by the claimant’s attorney regarding alleged unpaid medical bills. MLG Attorneys were retained immediately following the WCJ’s Decision for purposes of pursuing an Appeal to the Workers’ Compensation Appeal Board. MLG Attorneys were successful in convincing the Appeal Board to grant supersedeas so that no payments needed to be made during the pendency of the Appeal. Ultimately, after oral argument and the submission of written briefs, the Appeal Board reversed the WCJ’s award of penalties and attorney fees in full finding no violation of the Workers’ Compensation Act occurred. MLG Attorneys successfully defended further Appeals filed by the claimant’s attorney to the Commonwealth Court of Pennsylvania and to the Pennsylvania Supreme Court. Additionally, MLG Attorneys defeated the claimant’s attorney’s attempts at having the compromise and release settlement agreement set aside.​
